1. Introduction and Acceptance of Terms

Welcome to Mind & Body Garden Psychology Inc. ("The Practice," "We," "Us"). By accessing our website, purchasing our online courses, subscribing to our newsletters, or scheduling an appointment, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Practices.

These terms apply to all visitors, users, clients, and others who access our services.

2. Medical Disclaimer

For Educational Purposes Only:

All content provided on this website—including blog articles, newsletters, social media posts, and online courses—is for educational and informational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

  • No Doctor-Patient Relationship: Using this website or interacting with us on social media does not establish a clinician-patient relationship.

  • Emergencies: If you are experiencing a medical or mental health emergency, or if you have suicidal thoughts, please call 911 immediately or go to the nearest emergency room. You may also call the Suicide & Crisis Lifeline at 988. We cannot guarantee immediate responses to calls or emails during emergency situations.

3. Appointment, Cancellation, and Financial Policy

To ensure the highest quality of care for all patients, we strictly adhere to the following operational policies:

  • Appointments: In-office and telehealth visits are by appointment only. For telehealth sessions, a secure link will be sent to you approximately 48 hours and 10 minutes prior to your appointment.

  • Cancellation Policy: We require notification of cancellation at least 48 hours before your scheduled session time.

  • Late Cancellation & No-Show Fees: If you fail to cancel within the 48-hour window or do not show up for your appointment, you may be charged a late-cancellation fee equal to the full cost of the service. Insurance typically does not cover these fees.

  • Payment Authorization: By scheduling an appointment, you authorize Mind & Body Garden Psychology Inc. to keep your credit card on file. You agree that this card may be charged for any late cancellations, missed appointments, or outstanding balances (including copays and deductibles) not covered by your insurance.

  • Good Faith Estimate (No Surprises Act): Under the law, health care providers need to give patients who don’t have insurance or who are not using insurance an estimate of the bill for medical items and services. You have the right to receive a "Good Faith Estimate" for the total expected cost of any non-emergency items or services.

4. HIPAA Notice of Privacy Practices (Summary)

We are committed to protecting your medical information. In compliance with the Health Insurance Portability and Accountability Act (HIPAA), this notice summarizes how your Protected Health Information (PHI) may be used and disclosed.

  • Uses and Disclosures: We may use your PHI for treatment (providing care), payment (billing insurance), and healthcare operations (improving our services). We may disclose information to other healthcare providers to assist in your treatment.

  • State-Specific Protections: We comply with the California Confidentiality of Medical Information Act (CMIA) and New York Public Health Law, which often provide stricter privacy protections than federal law regarding mental health records.

  • Your Rights: You have the right to inspect and copy your medical records, request corrections to your records, request confidential communications, and receive an accounting of disclosures.

  • Full Notice: For a complete description of your rights and our legal duties, please review our full Notice of Privacy Practices via the link below. (DOWNLOAD OUR FULL HIPAA NOTICE OF PRIVACY PRACTICES)
